TERMS & CONDITIONS

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Career Tester,” “Host,” “you,” or “your”) and Limitlessgem LLC, doing business as JobsTester (“JobsTester,” “we,” “us,” or “our”).
By accessing, browsing, or using the JobsTester website, digital platform, or services (collectively, the “Platform”), you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree, you must immediately discontinue using the Platform.

1. About the JobsTester Platform

JobsTester is an online, two-sided marketplace designed to connect:

• Career Changers / Users seeking short-term, real-world career experiences (“Sessions,” “Experiences”), and

• Hosts / Mentors who offer such professional, hands-on experiences in their field of expertise.

JobsTester does not employ Hosts, nor does it provide or operate any Experiences directly.
We provide the technological platform, booking infrastructure, payment processing, and dispute-resolution mechanisms that enable Users and Hosts to interact.

2. Eligibility

To use JobsTester, you confirm that:

1. You are at least 18 years of age.

2. You have the legal capacity to enter into binding contracts.

3. You will comply with all applicable federal, state, local, and international laws.

4. You are not prohibited from using the Platform under any applicable jurisdiction.

If creating a Host account, you additionally confirm that:

• You possess the required knowledge, skills, professional qualifications, licenses, or permits (if applicable).

• Your work environment meets safety and insurance requirements.

3. JobsTester’s Role as a Limited Agent

JobsTester serves solely as a technological intermediary, providing:

• marketplace listing tools

• scheduling and availability management

• secure payment processing

• withholding of funds pending session completion

• complaint and refund mechanisms

• rating and feedback infrastructure

JobsTester is not responsible for, and does not guarantee:

• the safety, quality, legality, or accuracy of any Host services

• the behavior of Users or Hosts

• the outcome or educational value of any Experience

• insurance coverage or compliance by any Host

Hosts are independent contractors, not employees, partners, agents, or representatives of JobsTester.

4. User Responsibilities (Career Changers)

Users agree to:

• Provide accurate, truthful information.

• Attend the booked session at the scheduled time and location.

• Follow all safety guidelines and instructions provided by the Host.

• Communicate respectfully and professionally.

• Acknowledge that participation involves inherent risks associated with hands-on or workplace environments.

After completing a session, Users may:

• leave a rating

• provide optional public feedback

• file a complaint within 48 hours

Users may not:

• harass Hosts

• attempt to bypass the Platform to avoid fees

• engage in unsafe behavior during sessions

5. Host Responsibilities

1. Safety & Insurance

• Maintain a safe, professional, and compliant environment.

• Carry appropriate liability insurance (general, professional, or business liability depending on the field).

• Provide safety briefings or protective equipment where appropriate.

2. Legal Compliance

• Comply with all applicable industry standards, licenses, regulations, and zoning laws.

• Ensure all activities are lawful and appropriate.

3. Session Quality

• Deliver the experience as described.

• Supervise Users directly and maintain control of the environment.

4. Professional Conduct

• Communicate clearly, respectfully, and professionally.

• Not solicit Users for off-platform payments.

Hosts cannot:

• Rate Users

• Make medical, legal, or financial claims

• Provide hazardous or unsafe experiences

6. Payments, Fees & Payouts

JobsTester uses third-party payment processors (e.g., Stripe).
By using the Platform, you agree to comply with their terms as well.

6.1 User Payments

Users pay at the moment of booking.
Funds are securely held until:

• the session is completed AND

• 48 hours pass without complaint.

6.2 Host Payouts

Hosts are paid out automatically after:

• 48 hours following session completion

Unless a User submits a dispute or refund claim within that period.

JobsTester may withhold or reverse payouts if:

• fraudulent activity is suspected

• poor-quality or unsafe sessions are reported

• evidence supports a User complaint

7. Refund Policy

Users may cancel and receive:

• 100% refund if cancelled more than 48h prior to the session

• 50% refund if cancelled 24–48h prior

• 0% refund if cancelled within 24h

If a Host cancels or does not appear, Users receive a full refund.

8. Disputes, Complaints & Resolutions

Users may submit a complaint within 48 hours after the session.
JobsTester may request evidence from both sides, including:

• communication logs

• photos/videos

• session descriptions

• safety concerns

• timing/location data

JobsTester will determine:

• full refund

• partial refund

• no refund

• Host suspension or removal

JobsTester’s decision is final.

9. Assumption of Risk & Liability Disclaimer

By participating in any Experience, Users acknowledge:

• They are voluntarily engaging in a real-world, hands-on work environment.

• Such environments carry inherent risks (physical, environmental, mechanical, etc.).

• JobsTester is not liable for injuries, damages, losses, or accidents.

Hosts are fully responsible for:

• safety conditions

• insurance coverage

• compliance with laws

• supervision of Users

Users participate at their own risk.

10. Intellectual Property

All copyrights, trademarks, logos, visual design, and platform content belong to JobsTester.

Users and Hosts may not:

• copy the platform

• scrape or download content

• replicate design elements

• create derivative platforms

11. Prohibited Uses

Users and Hosts may not use the Platform for:

• illegal activities

• off-platform payment arrangements

• fraud or identity manipulation

• adult or sexually explicit sessions

• hazardous, unlicensed, or unsafe activities

• harassment or discrimination

12. Termination of Accounts

JobsTester may suspend or terminate accounts for:

• repeated complaints

• safety violations

• fraud or misuse

• breach of these Terms

Users may request account deletion at any time.

13. Changes to the Terms

JobsTester may update these Terms periodically.
Continued use of the Platform constitutes acceptance of any future changes.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles.
Any disputes shall be resolved in:

• State or Federal courts located in Wyoming.
